Terms and conditions

The present general conditions of sale have for object to define the rights and obligations of the company The Witching Hour and its consumers within the framework of the on-line sale of the items proposed on the present website www.the-witching-hour.com.

The Witching Hour reserves the possibility of adapting or modifying at any time the present general conditions of sale. So we invite you to consult them regularly.

The sales carried out via our online store are subjected to the present general conditions of sale and any order placed by the purchaser implies his acceptance on the contents of the provisions below.

Modalities, descriptions and prices:

The items proposed for sale in the store are presented and detailed so that any consumer is able to know the essential characteristics of the products he/she would like to buy. We include the composition and dimensions through the different tabs available on each product sheet so that each customer can know the articles in detail before buying them. 

The photos that illustrate the description of the items are given as an indication and are not contractual. You will not necessarily receive the item presented in the photo (unless otherwise stated in the description), moreover the stones used may be natural and the products are handcrafted, there may be differences in color and details between the product photographed and the one the buyer will receive. These differences are of course minimal and this is always specified on the article sheet of the products concerned.

We invite you to read the description of each article and to contact us via our contact form if you have any question.

Prices and VAT: 

Prices are in euros and do not include shipping costs. The store is registered as a micro-company, so we do not charge VAT. The prices indicated are therefore exclusive of tax, but no tax will be charged during the ordering process, except if you live in Great Britain since the Brexit we are obliged to collect the tax which is then paid to the British government.

The store reserves the right to revise its prices at any time but commits itself to apply the prices in force at the time of the order and this, subject to availability at this date.

Availability of the items: 

The products presented on our online store are valid within the limits of available stocks. In case of unavailability, the products will be displayed as "out of stock" in the description and you will not be able to buy them.

Sometimes we allow the sale of products that are no longer in stock, it is then a pre-order allowing you to buy the product before we have manufactured it. In this case the delivery time will be specified and your order will be put on hold until the product is available and can be shipped to you. If the product could not be available, a replacement product can be offered, a credit note or a refund.

Deliveries and returns

The transport of your package

Packages are generally dispatched within 72h hours after receipt of payment (except during weekend). Delivery times may vary depending on the destination country, the shipping method chosen and the speed of the postal service.

The shipping method and the delivery fees depend on the weight of the package and the destination zone of the order. They are calculated according to the rates of the postal service and include packaging, handling and postage.

We advise you to group your purchases in a single order to save on shipping costs. If you place more than one order on the same day, we will not be able to consolidate these orders into one package and you will be required to pay shipping charges for each one.

It is very important to us to provide you with the best possible shopping experience, which is why we take special care with each package, and why the goods you have ordered are always generously wrapped to be perfectly protected. We try as much as possible to use recycled and recyclable packaging for the preparation of your orders.

Packages are systematically sent with a tracking number that will allow you to follow the progress of your order and will attest to its delivery.

When you order, you will have the possibility to choose different delivery methods offering you different services such as delivery against signature or insurance to protect you in case of loss of the parcel by the postal service. For parcels in France, we offer insurance and delivery against signature for any order over 70 euros.

The customer will always be informed of the delivery costs of his order after having given his address and before proceeding to the payment.

It also happens that the postal service takes longer than usual, especially during sales, vacations or during the end of the year. We invite you to take this into account when placing an order during these times of the year.

These possible delays are totally independent of our will and we have no control over them, therefore the store cannot be held responsible.

The customer is responsible for verifying the accuracy of the information provided to the store.

In case of return of the package because of wrong address given by the customer, missing name on the mailbox or not withdrawal of the package in the post office, the cost of re-sending the package may be claimed to the customer before returning the order.

If your package is not delivered:

In case of non-receipt of the package, the tracking number will attest to the delivery or non-delivery of the package.

The customer will have to contact the store as soon as possible to report the non-receipt of the package. After examining the situation, a claim may be filed with the postal service by the store. The tracking number of your package is there to protect your purchases and to help us find them via the claim made to the Post Office.

Please know that we take this type of situation very seriously and we make it a point of honor to resolve them.

If after filing the claim the Post Office confirms that your package is lost, we will return the goods to you. Please note that a claim systematically involves an investigation by the postal service and that this can cause delays of up to 2 months if you are located outside France.

The tracking number being proof of the shipment of the package, the store can not be held responsible for the possible non-receipt of the package and / or its loss by the postal service.

Therefore, no refund or exchange can be claimed without a complaint to the Post Office (made by us), and a response from the postal service stating that the package is lost.

If the tracking number of the package indicates that it has been delivered, no claim can be made to the postal service, and no exchange or refund can be made.

If you frequently encounter difficulties in having your orders delivered by the postal service, we invite you to choose the delivery method "Colissimo with signature" in order to avoid any problem.

It is also up to the customer to make sure that his name is on his mailbox so that the letter carrier can make the delivery of the package.

Custom charges, taxes for international customers:

During international shipping, customs charges or taxes can be asked to the customer in case of control of the package.

This fact is totally out of The Witching Hour control, so their amount cannot be asked to the store. Only the buyer will have to pay every taxes and custom charges asked by the postal service.

Return of the items:

According to the law, the buyer has a time allowed of 14 days from the reception of the order to return the item bought. The right of return can be applied only if the procedure below is respected and only if the items returned during the time allowed of 14 days still be sealed and in perfect condition.

Above all return, the customer has to contact the customer service of The Witching Hour by email, via the contact form of the online store.

The returned package must be shipped with a tracking number. In case of loss of the package by the postal service, The Witching Hour will ask you the number to track the package.

The shipping costs of the package to return the items are chargeable to the sender. No package sent in mode with repayment will be accepted by The Witching Hour.

If the procedure above is respected, The Witching Hour makes a commitment to make an exchange or a refund of the items for a maximum time allowed of 14 days following the reception of the returned goods.

Payment:

The items ordered are payable counting and without any discount, the means of payment is in the choice of the buyer

among those proposed by The Witching Hour and depending of the country of the buyer:

-Credit card payment: payments are made via the solution of secure on-line payment Payplug.

The Witching Hour will never have any access to your payment informations.

-Bank transfer: The customer has a time allowed of 7 days to make the bank transfer, after these 7 days the order will be cancelled.

If you have not received the email containing the payment information, please check the spam folder in your emailbox.

- Amazon Pay: Pay with your Amazon account. We haven't any access to your payment informations.

The Witching Hour has no access to the bank informations.

- Paypal: Pay with the secured payment method Paypal. We have no access to your bank informations.

As a result of which these informations are not kept on the servers and are asked at every new transaction on the website.

Reservation of property:

In accordance with the law n°80.335 of May 12, 1980, the store reserves the property of the ordered goods until the integral payment of their price.

Processing of personal data, privacy policy:

During the ordering process, the store collects your name, first name, address and email address in order to process and ship your order.

Your name, first name and address (and telephone number if you wish to give it) are then transmitted to the Post Office insofar as they appear on your package and this with the only aim that you can receive the products that you ordered. If you are located outside of France, these informations may also be transmitted to the customs service.

This information collected by The Witching Hour will never be transmitted to third parties, apart from the postal service and the customs services.

Your informations are kept on the server and are only accessible by you, by connecting to your customer account, and by The Witching Hour.

You can at any time rectify these informations via your customer account or request the deletion of your customer account (which will result in the deletion of these informations on our server) via the contact form available on the online store.

The store never has access to your payment informations.

Litigation:

The present general conditions of sale are governed by French law. 

Any dispute relating to the interpretation or the execution of the orders will be examined with the greatest care and will be the subject of an immediate amicable proposal.

In case of unresolved dispute between the store and the buyer, only the commercial court closest to the store will be competent in the matter.
